Terms of Service

These Terms of Service ("Terms") govern your access to and use of RapidThumbnails ("Service", "we", "us"). By creating an account, paying for a subscription, or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement.

2. Account Registration

Some features require an account. You agree to provide accurate information, to keep your login credentials confidential, and to notify us promptly of any unauthorized access. You are responsible for all activity under your account.

3. Subscriptions, Credits & Billing

Paid plans renew automatically each cycle until canceled. Credits granted by a monthly subscription expire at the end of the cycle, subject to the rollover rules described on our pricing page. Top-up credits, purchased separately, do not expire.

• Failed payments may result in account downgrade or suspension.
• Refund eligibility is governed by our Refund Policy.

4. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy. Violations may result in suspension or termination of your account without refund.

5. User Content & License

You retain ownership of content you upload (including reference photos and face likenesses) and of content you generate using the Service, except where specifically called out by the underlying AI model providers' terms. By uploading content, you grant RapidThumbnails a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display that content for the sole purpose of operating the Service for you. This license terminates when you delete the content or close your account, except to the extent necessary for legal compliance, dispute resolution, or backup integrity.

We do not use your content to train AI models. Reference photos and generated outputs are not added to any training corpus. They are transmitted to our AI providers (currently fal.ai for image generation and Google Gemini for analysis) only as necessary to render the result you requested.

6. AI-Generated Content

Our outputs are generated by machine-learning models and may contain errors, artifacts, unintended likenesses, or content that resembles existing works. You are responsible for reviewing, editing, and using outputs in compliance with applicable law. 7. Intellectual Property

RapidThumbnails, the RapidThumbnails logo, and all related marks, software, designs, and content we provide are owned by us or our licensors. Except for the limited rights expressly granted in these Terms, no other rights are conveyed.

8. Third-Party Services

The Service integrates third-party providers (Stripe for payments, Supabase for authentication and storage, Cloudflare R2 for file storage, fal.ai for image generation, Google for language-model analysis). Your use of those features is subject to their respective terms and privacy policies, in addition to ours.

9. Termination

You may cancel at any time from your dashboard. We may suspend or terminate access for violations of these Terms, the Acceptable Use Policy, or any other operating policy. Termination does not relieve you of obligations incurred before termination, including outstanding fees and indemnification.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI outputs. We do not warrant that outputs will be free of artifacts, copyright concerns, or biases inherent in the underlying models.

11. Limitation of Liability

To the maximum extent permitted by law, RapidThumbnails and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any direct damages will not exceed the amount you paid us in the twelve months immediately preceding the event giving rise to the claim, or USD $100, whichever is greater.

12. Indemnification

You agree to defend, indemnify, and hold harmless RapidThumbnails from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms or applicable law, including third-party rights and AI content disclosure laws.

13. Changes to the Terms

We may modify these Terms from time to time. Material changes will be communicated by email or an in-product notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

14. Governing Law & Disputes

These Terms are governed by the laws of [Governing State / Country pending counsel advice], without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in [Venue pending], and you consent to the personal jurisdiction of those courts.
